1. Scope and Acceptance
These Terms of Use govern access to and use of the website privatkredit.ch and all associated landing pages, forms, apps, and digital services (together the "Platform") of privatkredit.ch AG, Roosstrasse 53, CH-8832 Wollerau, Switzerland ("we", "us", also: "Platform Operator").
By accessing the Platform, submitting a form, or registering, you confirm that you have read, understood, and accepted these Terms of Use and our Privacy Policy.
2. Our Service and the Role of AS Finanz GmbH
We operate a digital platform for receiving inquiries for financial products and services, in particular personal loans.
Exclusive partnership with AS Finanz GmbH: Inquiries received via the Platform are forwarded, within the scope of an exclusive partnership, to AS Finanz GmbH, Badenerstrasse 676, CH-8048 Zurich (hereinafter the "Broker"). The Broker holds the authorization to broker consumer credit from the Office for Economic Affairs of the Canton of Zurich, based on Art. 39 of the Federal Act on Consumer Credit (Consumer Credit Act, CCA) and Art. 4–8 of the Ordinance to the Consumer Credit Act. The entire processing of your inquiry, its review and qualification, the procurement of offers, and the brokering to banks, credit institutions, and other providers are carried out by the Broker. To the extent privatkredit.ch AG itself holds an authorization to broker consumer credit, it acts exclusively as a sub-broker of the Broker; the operational handling and brokering are, even in that case, carried out by the Broker.
The Broker brings customers together with licensed providers of financial products and services, in particular banks and credit institutions for personal loans, as well as with other partners whose offerings are directly or indirectly related to credit products.
Neither we nor the Broker are a bank or a lender. We do not grant loans, do not maintain accounts, and are not subject to the Swiss Banking Act. The conclusion of a loan agreement or any other contract takes place exclusively between you and the respective provider and is subject to that provider's terms and the applicable laws, in particular the CCA.
No offer, no advice: The information on the Platform (including calculators, indicative values, and comparisons) constitutes neither an offer nor financial, legal, or tax advice. There is no entitlement to successful brokering or to the conclusion of a contract.
Statutory warning notice: The granting of credit is prohibited if it leads to the over-indebtedness of the consumer (Art. 3 UCA).
3. Intended Audience
The Platform is directed at adult natural persons with full legal capacity resident in Switzerland, as well as at cross-border commuters whose place of work is in Switzerland. The information is not intended for persons whose country of residence prohibits access to such content.
4. Your Obligations
You undertake to:
- provide all information (in particular regarding identity, income, expenses, existing obligations) completely and truthfully, and to report any changes without delay;
- submit documents only concerning yourself or with the consent of any affected third parties (e.g. spouse or life partner);
- not use the Platform in an abusive manner (no automated scraping, no manipulation, no circumvention of security measures).
False or incomplete information may lead to rejection of the application and may have criminal consequences.
5. Credit Application: Power of Attorney, Authorizations, Releases from Secrecy, and Acknowledgments (DISCLAIMER)
a) Data transmission already at the time of completing the form: By completing the fields under "Personal Information," your contact information is transmitted to privatkredit.ch AG. You authorize us to use this data for processing and marketing purposes, to forward it to the Broker, and to contact you where applicable, even if you do not complete all steps of the credit application. The Broker may contact you to the same extent.
b) Power of attorney to forward to the Broker and to financing institutions: You grant privatkredit.ch AG power of attorney to forward your inquiry, together with the data you have provided and the documents you have submitted, to the Broker (AS Finanz GmbH). You grant the Broker power of attorney to process your inquiry, procure offers, coordinate the process, and communicate with providers on your behalf. You acknowledge that the Broker will forward your application for review – directly or indirectly as a sub-broker – to Cembra Money Bank AG, BANK-now AG, Cornèr Banca SA, as well as to other financial institutions or other providers (each individually hereinafter the "Financing Institution") via the internet, by e-mail, or by post.
c) Application review and credit reference data: You confirm the completeness, currency, and accuracy of all information provided in the application and authorize the Financing Institution, in connection with the review of the application and the handling of the contractual relationship, to obtain information about you from third parties, in particular from banks, the Central Office for Credit Information (ZEK), authorities (e.g. debt collection offices, land registries and tax offices, residents' registration offices, child and adult protection authorities), commercial credit reporting agencies, credit brokers, employers, group companies of the Financing Institution, and, where applicable, the Consumer Credit Information Office (IKO). For the aforementioned purposes, you release these bodies from banking client, postal, official, or business secrecy.
You acknowledge that the Financing Institution may, where applicable, be obliged to report consumer leasing or a consumer credit to be granted or already granted to the IKO. You further authorize the Financing Institution to report the requested transaction to the ZEK and, where corresponding statutory obligations exist, to report it to other bodies as well. The information reported includes in particular the type, amount, and terms of the credit or financing, as well as the personal details of the applicant(s) and, where applicable, qualified payment arrears or instances of abuse. You acknowledge the right of the ZEK to provide its members with information based on the reported data. The Financing Institution may reject the application without stating reasons.
d) Cooperation between the Financing Institution, the Broker, and the Platform Operator: You acknowledge that, for applications it receives from the Broker, the Financing Institution may exchange with the Broker the information necessary in connection with the review of the application and creditworthiness, as well as the conclusion and handling of the contract (e.g. parameters and outcome of the application review, delivery of contract documents, information on contract status and payment behavior, as well as balance). The Broker may share this information with the Platform Operator to the extent necessary for processing your inquiry, communicating with you, and billing. To this extent, and insofar as necessary, you release the Financing Institution from Swiss banking secrecy. This includes, in particular, informing the Broker and the Platform Operator of the conclusion of the contract and the disbursement of the credit, among other things for the purpose of settling the brokerage commission (Sec. 8). The Broker and the Platform Operator may communicate with you regarding the status of your application and contract via the agreed communication channels (Sec. 6). Neither the Platform Operator nor the Broker is itself subject to Swiss banking secrecy; they process your data in accordance with their respective privacy policies and the Swiss Federal Act on Data Protection (FADP).
e) Information regarding partners: If you have provided information in the application regarding your spouse or your registered partner ("Partner"), you confirm that (i) you have informed your Partner about this application, (ii) the Financing Institution may verify the information provided by directly contacting your Partner, and (iii) your Partner consents to the Financing Institution obtaining information concerning them as described above (including making informational inquiries with the ZEK).
f) Data processing by the Financing Institution: You acknowledge that the Financing Institution may process your data for the purpose of reviewing your application as well as for risk assessment and marketing purposes (data analysis and profiling). In addition, other products and services, including those of group companies of the Financing Institution and other third parties, may be offered to you by post or telephone. You may object to this data processing for marketing purposes at any time. By providing your e-mail address, you further agree that the Financing Institution may also send you the aforementioned offers by e-mail. In connection with open communication via e-mail, you expressly accept the risk that your data may be intercepted or disclosed by third parties during transmission, or that unauthorized third parties may draw conclusions about a contractual relationship between the Financing Institution and you, and that, to that extent, secrecy protection or Swiss banking secrecy cannot be guaranteed. You may revoke your consent to the electronic delivery of promotional material at any time.
g) Cooperation of the Financing Institution with service providers (outsourcing): You acknowledge that the Financing Institution may outsource services to third parties ("Service Providers"), in particular in the areas of business process handling, IT security and systems management, market research and processing, the calculation of business-relevant credit and market risks, and the administration of contractual relationships (e.g. application and contract handling, debt collection, customer communication). The Financing Institution provides these Service Providers with the data necessary to fulfill the contractual obligations and may, for this purpose, also transfer such data abroad. Service Providers, their employees, and subcontractors are contractually bound by the Financing Institution to confidentiality. Service Providers are generally located in Switzerland or the EU/EEA but may, in principle, be established anywhere in the world. If personal data is transferred to a country that, from a Swiss perspective, does not provide an adequate level of data protection, the Financing Institution ensures adequate data protection through appropriate safeguards, such as the agreement of standard contractual clauses.
h) Electronic communication: You acknowledge that communication between the Financing Institution and you, the Broker, or the Platform Operator may take place via electronic channels. The Platform Operator, the Broker, and the Financing Institution cannot guarantee the confidentiality of data transmitted over the internet. Third parties may therefore be able to draw conclusions about an existing or forthcoming business relationship (possibly a banking relationship) between you and the Financing Institution.
i) Privacy policies: Further information on the processing of personal data by the Broker can be found in its privacy policy at asfinanz.ch; further information on processing by the Financing Institution can be found in the privacy policy on the respective Financing Institution's website.
You may revoke any consents given at any time, with effect for the future; data transmissions that have already taken place remain unaffected.
6. Communication
We and the Broker communicate with you via the channels you have provided, in particular telephone, e-mail, SMS, and messaging services such as WhatsApp (WhatsApp Business). You acknowledge that electronic communication channels (e-mail, messengers) are not fully secure and that data transmitted through them may pass through servers located abroad (including the USA). If you do not wish to use a particular channel, please let us know at any time; we will then use an alternative channel.
Telephone calls may be recorded for quality assurance, training, and evidentiary purposes; you will be notified of this at the beginning of the call.
7. Use of Artificial Intelligence
We and the Broker use AI-based systems, for example for the preliminary review and categorization of inquiries, the analysis of submitted documents, the enrichment and quality assurance of data, and in customer communication (e.g. chat assistants, drafting of responses). Details, the providers used, and your rights can be found in our Privacy Policy. Decisions with legal or significant effect (e.g. the credit decision) are made neither by us nor by the Broker; the credit decision rests in every case with the respective Financing Institution (Sec. 5).
8. Costs
Use of the Platform is free of charge for you. In the event of success, the Broker is compensated by the providers (brokerage commission); privatkredit.ch AG receives compensation from the Broker for referring and, where applicable, sub-brokering inquiries. No additional costs arise for you as a result.
9. Intellectual Property Rights
All content on the Platform (texts, images, logos, software, design) is protected by copyright and trademark law. Any use, reproduction, or redistribution going beyond mere browsing, for public or commercial purposes, requires our prior written consent.
10. Availability and Liability
We strive for high availability of the Platform but assume no guarantee for it. We may modify, interrupt, or discontinue the Platform at any time.
To the extent permitted by law, we exclude any liability for damages arising from the use or unavailability of the Platform, from the transmission of data over the internet, and from acts or omissions of the Broker and the brokered providers. Liability for unlawful intent and gross negligence remains reserved.
11. Links to Third-Party Sites
Links to third-party websites are provided for your information only. We have not reviewed their content and assume no responsibility for it.
12. Amendments
We may amend these Terms of Use at any time. The version published on the Platform at the relevant time shall govern.
13. Governing Law and Place of Jurisdiction
These Terms are governed exclusively by Swiss law, to the exclusion of its conflict-of-laws provisions. The exclusive place of jurisdiction is Wollerau (Canton of Schwyz), subject to mandatory statutory places of jurisdiction (in particular for consumers).
